Packages & Pricing — Frequently Asked Questions
Straight answers about our §2(d) confusion-refusal services, packages, timelines, and terms.
What does IPED do—and is it a law firm?
IPED is a specialized, administrative service focused on overturning USPTO §2(d) likelihood-of-confusion refusals. We are not a law firm and do not provide legal advice. We act as a scrivener—preparing documents and managing procedural steps based on your direction and public data.
What is the LOCA report, and how is it different from a basic search?
LOCA (Likelihood of Confusion Analysis) is a data-driven assessment that “stress-tests” your mark against relevant precedents and market context. It uses insights from hundreds of TTAB reversals and a structured, per-factor DuPont analysis to deliver a clear probability range and a blueprint for your response.
Which package should I choose?
- Simple Response: minimal, DIY-friendly argument; you file; no revisions.
- Basic: comprehensive draft; 1 revision; you file.
- Premium: hands-off service; we manage filing, include simple issues, and provide up to 3 revisions + 1 R4R if needed.
- Pro: all Premium features plus a strategic refiling if the first response and included R4R fail.
- SuccessPay Plus: Premium service split into an upfront fee and a success fee (due upon approval for publication after our response/R4R).
- SuccessPay Advance: Basic-level drafting with the lowest upfront fee; success fee due if approved after the initial response; no R4R.
Do you file as attorney of record on all plans?
We handle filing and matter management on Premium, Pro, and SuccessPay Plus. Simple, Basic, and SuccessPay Advance are self-filing tiers (we prepare; you submit).
What are your timelines and revision policies?
Drafting is generally delivered within 30 business days or less once we receive all inputs. Revisions: Basic includes 1; Premium/Pro/SuccessPay Plus/SuccessPay Advance include up to 3.
How do success-based packages charge and when is the fee triggered?
- SuccessPay Plus: upfront + success fee due only if the examining attorney approves for publication after our first response or the included R4R.
- SuccessPay Advance: lowest upfront; success fee due only if approved for publication after the one-time response (no R4R in this tier).
Do you guarantee approval? What is your success rate?
No service can guarantee outcomes. IPED reports high success rates for full-service responses, driven by deep specialization and data-backed drafting. Success-based tiers align payment with results to reduce your upfront risk.
What’s included vs. not included in the fees?
Our fees cover analysis, drafting, and (where applicable) filing/case management and one R4R on eligible tiers. Government/USPTO fees, appeals, and new applications are not included unless expressly stated.
How do confidentiality and dispute terms work?
All communications are confidential under a mutual NDA; the T&Cs include a mutual non-disparagement clause. Disputes are handled via good-faith negotiation, then binding arbitration in Wyoming under Wyoming law.
What do you need from me to get started, and what’s my role?
Please provide your mark, USPTO serial number, the Office Action PDF, deadlines, and any exhibits. We handle the heavy lifting; you review drafts promptly so we can meet timelines or, if needed, request extensions.
