What’s the main difference between Standard and Contingency-based (SuccessPay) packages?
Standard packages (Basic, Premium, Advanced) have a fixed upfront fee that covers all the services included in that tier. Contingency-based packages (SuccessPay, SuccessPay Plus, SuccessPay Pro) feature a lower initial upfront fee, combined with a "Success Fee." This Success Fee is only charged if the response we prepare successfully overcomes the USPTO's refusal, leading to your application being approved for publication.
Are the USPTO’s official filing fees included in your package prices?
No. Our package fees cover our analysis, drafting, filing assistance, and support services as outlined. Any fees required by the USPTO (like response filing fees or fees for Requests for Reconsideration) are separate and must be paid directly to the USPTO by you.
How does the Success Fee work for contingency packages?
The Success Fee is invoiced and payable only after the USPTO officially approves your trademark application for publication, following the submission of the response we prepared under your SuccessPay package. If the application is not approved for publication after our response, you will not be charged the Success Fee.
Are the upfront package fees refundable?
Generally, the upfront fees for all packages are non-refundable once we have begun work. These fees cover the initial analysis, resource allocation, and work performed. Please see our full Terms & Conditions for specific details.
About Scope of Services
Does your service provide legal advice or act as my attorney?
No, this is a critical distinction. We provide expert administrative, procedural, and strategic drafting support. We specialize in understanding USPTO processes and preparing strong responses based on research and experience. However, we are not a law firm and cannot provide legal advice, legal opinions (such as guaranteeing trademark clearance), or legal representation.
What does “Attorney Review & Filing” in the Advanced package mean?
For the Advanced package, after we draft the response strategy and arguments, we coordinate with an independent, licensed U.S. trademark attorney. This attorney reviews the response for legal sufficiency and handles the formal filing with the USPTO. We facilitate this coordination, but the attorney performs the legal review and filing.
What is “Assisted Filing”?
Assisted Filing (included in Premium, SuccessPay, SuccessPay Plus, and SuccessPay Pro) means we handle the administrative task of submitting the finalized response document to the USPTO's online system on your behalf, once you have approved it. This is different from “Self-Filing,” which is required for the Starter and Basic packages.
What does “Case Management” include?
Case Management (included in Premium, SuccessPay, SuccessPay Plus, and SuccessPay Pro) typically involves monitoring your application’s status on the USPTO register, docketing key deadlines related to the response, and keeping you informed throughout the process covered by your package.
What is “Request for Reconsideration support (second response)”?
This feature (included in Premium and SuccessPay Plus) means that if our initial response doesn't fully resolve the refusal, but a Request for Reconsideration is a viable next step according to the USPTO's rules, we will provide support in preparing and filing that specific type of follow-up response as part of the original package fee.

Starter: Best if you're on a tight budget and primarily want analysis and an outline to draft the response entirely yourself (requires self-filing).
Basic: Good if you want a professionally drafted starting point but are comfortable handling the filing and any follow-up communications yourself (requires self-filing).
Premium: Ideal if you want more comprehensive support, including filing assistance, case management, handling of simpler subsequent issues, and consultation.
Advanced: Best for complex refusals, situations where attorney oversight is desired, or if you prefer the highest level of support within a fixed-fee model.
SuccessPay Packages: Offer alternative payment structures for varying service levels (similar to Basic+ or Premium), reducing the initial cost but including a larger fee payable only upon successful publication approval. How long does it typically take to receive the draft response after purchasing a package (Basic and above)?
Turnaround times can vary depending on the complexity of the refusal and our current workload. However, we generally aim to deliver the initial draft response within the timeframe specified in our service agreement (often around 15-30 business days) after we receive all necessary information from you. We always prioritize meeting the USPTO's deadlines.
